I, Betty Harmon daughter of (Lilly M Harmon) deceased, hereby file this complaint with the United States Department of Justice, Civil Rights Division. I demand that DOJ/CRD conduct a thorough investigation into the deliberate and inappropriate behavior from the Fresno local authorities, such as The Fresno Police Department, The Fresno Sheriffs Department, The Fresno Internal Affairs Office, The Fresno local DA's Office, The Fresno County Coroner's Office, and all said others affected or influenced by such said entities.
I am filing this complaint and request for investigation under the Title VI Civil Rights Act of 1964 U.S.C. 42.1981, U.S.C. 42.1983, and U.S.C.42.1985 statues derived from the acts of the reconstruction era, that protect against discrimination includes: Civil Action for deprivation of rights and the Age Discrimination Act of 1975 U.S.C. 42.6101-6107 No person in the United States shall, on the basis of age, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under, any program or activity receiving Federal financial assistance.
Additionally, I am asking that DOJ will initiate thier police misconduct pattern and practice program and uphold the Act of 1994,42 U.S.C. Section 14141, This Act of 1994 prohibits Law Enforcement from regularly violating existing protections from policy misconduct under federal statue and Act of 1968,42.U.S.C. 3789d states the Attorney General delegates authority to enforce this statue thereby eliminating a "pattern or practice of conduct by Law Enforcement officers that deprives persons of rights, privileges, or immunities secured and protected by the Constitution or Laws of the United States. See Attachment II for related case that reflects a pattern of law enforcement misconduct on elder abuse reports in the City of Fresno, California (surviving son is John Steinhauer).
I believe my mother Lilly M Harmon age 85 at time of death and myself Betty Harmon rights were denied, and obstructed based on race, sex, age and disability.
I am seeking redress yet to be determined, on behalf of my mother (Lilly M Harmon) and myself the daughter (Betty Harmon) based on the deprivation of our rights, privileges, and immunities secured by the Constitution and laws, costs of exhumation of my mother's body, and all related costs connected to this extensive investigation I had to perform due to the obstruction of the Fresno City local entities, and hardship and mental anguish its placed on me for the last 2 1/2 years.
The initial dates of discrimination are 12/23/2004 and continue to present.
In addition, I seek a waiver of required 180 days filing requirement of alleged discrimination due to reasons listed below.
1st Fresno Local Officials obstruction of reported crime as a mandated reporter they refused/fail to take action on a crime reported to them against an elderly over age 60 my mother (Lilly M Harmon).
2nd I had to perform as a layperson to investigate my own mother's abuse and death and the unnecessary time it took to request the California State Attorney General - BMFEA to handle initial charges that the local Fresno City refused.
3rd The denial from Fresno local Coroner to exhume my mother (Lilly M Harmon's) body to perform autopsy, when there was obvious supporting documentation to warrant my request as a crime had been committed.
4th Preparation time to pool monies together to afford the cost of exhumation to perform autopsy now being confirmed as homicide by autopsy performed on my mother (Lilly M Harmon) by Dr Matthias Okoye MD,JD, received official report in March of 2007.
